Welcome to GuidedGrowth Support, operating as Guided Growth | Fitness. By booking a session, purchasing a plan, or using any of our services, you acknowledge and agree to the following Terms and Conditions. Please read them carefully.
1. Assumption of Risk and Release of Liability
1.1 Voluntary Participation – You understand that participation in any fitness coaching, workouts, or consultations provided by GuidedGrowth Support is voluntary and carries inherent risks. These risks may include, but are not limited to, muscle strain, injury, illness, falls, equipment-related incidents, or in rare cases, serious health complications.
1.2 Medical Clearance – You affirm that you are physically capable of participating in fitness activities and have consulted with a physician, if necessary, prior to starting any exercise program.
1.3 Release of Liability – You release and discharge GuidedGrowth Support, operating as Guided Growth | Fitness, including its owners, employees, contractors, affiliates, and representatives, from any and all liability, claims, or damages arising from participation in any coaching sessions or related activities, whether caused by negligence or otherwise.
1.4 California Civil Code § 1542 Waiver – You expressly waive all rights under California Civil Code § 1542, which states:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release, and that, if known by them, would have materially affected their settlement with the debtor or released party."
2. No Medical Advice
2.1 Not a Substitute for Professional Care – All information provided through our coaching sessions, programs, or materials is for general fitness purposes only and should not be considered medical advice.
2.2 Consult Your Physician – Always consult a qualified healthcare provider before starting any new exercise, nutrition, or wellness program, particularly if you have pre-existing health conditions or concerns.
3. Results Disclaimer
3.1 Individual results vary based on personal effort, consistency, health, and other factors. GuidedGrowth Support does not guarantee specific outcomes or results.
4. Payment, Refund, and Cancellation Policy
4.1 Payment Terms – Payment for coaching sessions or plans must be made in full prior to the start of services.
4.2 Cancellation Policy – Sessions may be rescheduled up to 24 hours before the scheduled time without penalty. Cancellations made with less than 24 hours’ notice may be charged in full.
4.3 Refunds – All sales are final. Refunds are only issued in cases where GuidedGrowth Support cancels a session and cannot provide an alternative time.
5. Intellectual Property
5.1 All materials, including but not limited to workout programs, guides, videos, and resources, are the intellectual property of GuidedGrowth Support.
5.2 You may not copy, share, resell, or distribute these materials without written permission.
6. Online Coaching Conduct
6.1 Clients are expected to behave respectfully during virtual sessions. Abusive language, harassment, or inappropriate behavior may result in termination of services without refund.
7. Technology and Internet Limitations
7.1 You acknowledge that virtual coaching requires a stable internet connection and functioning device. GuidedGrowth Support is not responsible for technical issues on the client’s end.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, GuidedGrowth Support is not liable for any indirect, incidental, or consequential damages arising from participation in its services.
9. Governing Law
9.1 These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions.
10. Changes to Terms
10.1 GuidedGrowth Support reserves the right to modify these Terms at any time. Updated terms will be posted on our website at https://www.guidedgrowthsupport.org/waiver.
